ALL PRISONERS ARE POLITICAL  BY SEAN SWAIN  1 used to assest policical prisoner status - much to the ire and annoyance of my captors. 1 even put “political prisoner” under my name in my return address on outgoing mail, and reccived incomin mail with *policical prisoner” onit. As a consequence, 1 rgued that the US. government implicily recognized me ss  policical prisoner since the US. postal service delivered mail to me under that designacion. Ifele chat the circumstances of my case being what they were, 1 qualified as a political prisoner. | had committed no crime. I had been in my own home when someone el broke in and thretened my li  in s panic,in self-defense, I stabbed and killed hirn.  He was the nephen of the clerk of courts.  What followed was a provably concerted effort by everyone from police to prosecucors to the judge - to conceal what really happened and to fabricate 2 “crime? essentially manipulats system of njustice as 2 tool for preserving the privileges of the ruling elite, and doing so at the expense of everyone clse. My case stood for the propasition that everyone is created equal... but some are more equal than others.. and no matter the circumstances, you may never kil anyone more equal than you. My political prisoner claim was further bolstered by the reversal of my false conviction and the trial  g the  courts subsequent refusal to provide me the fair trial ordered by the court of appeals. As a consequence, | have been held for nearly 24 years without a legal conviction or sentence. This totally irregular and exerajudicial captiviey, | asserted, only proved the truly political character of my imprisonment.  But o assert political prisoner status is to also admit the existence of “spolitical prisoners” That is, for political prisoners to exist, chere mast be some other class of prisoner from which political prisoners are disinguished, aclassof prisoner where the St exercised legitimate authority and served a legitimate governmental incerest i usingits police, courts,and prisons.  From an anarchist perspective,chisis problematic.  The State i force. The State is oppresion. It aseres  right to rule, arigh to assume powess it does not validly possess,a righe then o exploit and oppress. The  ate exercises this claimed suthority to  maintain and preserve ieself at all costs. “The question then arises, how can a  illegitimace authority ~ the State - exercise power i its own mainenance and preservation, and simultancously operate in the interests of those it ruls, exploits, and oppresses?  It cannor.  No ace the illegitimate State performs to maincain and preserve its power could conceivably serve the interests of the ruled, the exploited, and the oppressed. As an illegitimate power,the State can do nothing in the incerests of the ruled, the exploited, and the oppressed - shore of dissolving eself. The eradication of the Ste, and only the eradication of e State, could serve the interests of the ruled, the exploited, and the oppressed.  Police, courts, and prisons are certainly not tools for the illegitimate State’s eradication, the State’s dissolution. Police, courts, and prisons have always been essential tools for the maintenance and prescrvation of the State. Therefore, where the State employs police, courts and prisons, it does so for the State’ interests — and directly oppositional to the interests of everyone else who, we already established, would benefic from the State’s eradication, not the State’s preservation.  Given that police, courts, and prisons are tools for the atenance and preservation of the llegitimate State and icsinvalid ponwer to rule, exploit and punish, then every arrest and detention of every prisoner by the illegitimate State is undertaken in the defense of che illgitimate State - at the expense of those who it ruls, exploits and oppresses, those whose inerests would be served by the State’s eradication,  In light of this, there is no legitimate State action in imprisoning anyone. Every act of imprisonment serves an llegitimte State,an llegitimate Seate whose eradication would serve the interests of everyone. As an a  chist | have never encountered  legitimte  State. [ have never seen a legitimate exercise of State power. I have spolitical prisoner.  In the absence of a legitimate State, 3  W in the absence of
alegitimace use of State authority, there can be no legitimate use of police, courts,or prisons. All imprisonment is invalid and contrary to the interests of everyone. And as there exists no class of prisoner from which  olitcal prisoners” are to be distinguished, there can be no  such thing as spolitical prisoner with s special designation. 1 used to assest policical prisoner status - much to the ire and
annoyance of my captors. 1 even put “political prisoner” under my
name in my return address on outgoing mail, and reccived incomin
mail with *policical prisoner” onit. As a consequence, 1 rgued that the
US. government implicily recognized me ss policical prisoner since
the US. postal service delivered mail to me under that designacion.
Ifele chat the circumstances of my case being what they were,
1 qualified as a political prisoner. | had committed no crime. I had
been in my own home when someone el broke in and thretened my
li

in s panic,in self-defense, I stabbed and killed hirn.

He was the nephen of the clerk of courts.

What followed was a provably concerted effort by everyone
from police to prosecucors to the judge - to conceal what really
happened and to fabricate 2 “crime? essentially manipulats
system of njustice as 2 tool for preserving the privileges of the ruling
elite, and doing so at the expense of everyone clse. My case stood for
the propasition that everyone is created equal... but some are more
equal than others.. and no matter the circumstances, you may never
kil anyone more equal than you. My political prisoner claim was
further bolstered by the reversal of my false conviction and the trial

courts subsequent refusal to provide me the fair trial ordered by
the court of appeals. As a consequence, | have been held for nearly
24 years without a legal conviction or sentence. This totally irregular
and exerajudicial captiviey, | asserted, only proved the truly political
character of my imprisonment.

But o assert political prisoner status is to also admit the
existence of “spolitical prisoners” That is, for political prisoners to
exist, chere mast be some other class of prisoner from which political
prisoners are disinguished, aclassof prisoner where the St exercised
legitimate authority and served a legitimate governmental incerest i
usingits police, courts,and prisons.

From an anarchist perspective,chisis problematic.

The State i force. The State is oppresion. It aseres right to
rule, arigh to assume powess it does not validly possess,a righe then
o exploit and oppress. The

ate exercises this claimed suthority to

maintain and preserve ieself at all costs.
“The question then arises, how can a

illegitimace authority
~ the State - exercise power i its own mainenance and preservation,
and simultancously operate in the interests of those it ruls, exploits,
and oppresses?

It cannor.

No ace the illegitimate State performs to maincain and
preserve its power could conceivably serve the interests of the ruled,
the exploited, and the oppressed. As an illegitimate power,the State
can do nothing in the incerests of the ruled, the exploited, and the
oppressed - shore of dissolving eself. The eradication of the Ste, and
only the eradication of e State, could serve the interests of the ruled,
the exploited, and the oppressed.

Police, courts, and prisons are certainly not tools for the
illegitimate State’s eradication, the State’s dissolution. Police, courts,
and prisons have always been essential tools for the maintenance
and prescrvation of the State. Therefore, where the State employs
police, courts and prisons, it does so for the State’ interests — and
directly oppositional to the interests of everyone else who, we already
established, would benefic from the State’s eradication, not the State’s
preservation.

Given that police, courts, and prisons are tools for the
atenance and preservation of the llegitimate State and icsinvalid
ponwer to rule, exploit and punish, then every arrest and detention of
every prisoner by the illegitimate State is undertaken in the defense of
che illgitimate State - at the expense of those who it ruls, exploits
and oppresses, those whose inerests would be served by the State’s
eradication,

In light of this, there is no legitimate State action in
imprisoning anyone. Every act of imprisonment serves an llegitimte
State,an llegitimate Seate whose eradication would serve the interests
of everyone. As an a

chist | have never encountered legitimte

State. [ have never seen a legitimate exercise of State power. I have
spolitical prisoner.

In the absence of a legitimate State, 3

W in the absence of
alegitimace use of State authority, there can be no legitimate use of
police, courts,or prisons. All imprisonment is invalid and contrary to
the interests of everyone. And as there exists no class of prisoner from
which

olitcal prisoners” are to be distinguished, there can be no

such thing as spolitical prisoner with s special designation.
